These terms govern use of Cadence, a product of Modula Health (“Modula,” “we,” “us”). By completing the Cadence opt-in form or using Cadence, you agree to these terms and to the Privacy Policy. If you do not agree, do not opt in or use the service.
What Cadence is
Cadence is an SMS and web companion that helps patients capture the plan in their own words between therapy or medication-management sessions, and helps clinicians see those words before the next visit. The clinician confirms; Cadence does not author a care plan, make diagnoses, or give medical advice.
Cadence is for adults 18 and older in the United States who opt in on the public web form (on their own, or after a clinician invite) or who are invited by Modula.
What Cadence is not
- Not emergency care, not a crisis line, and not monitored 24/7 by a person.
- Not a replacement for your clinician, pharmacy, or 911.
- Not a guarantee that you will attend sessions or follow a plan.
If you are in danger, call 911. For mental-health crisis support in the US, call or text 988. If Cadence detects crisis language, it may send an automatic 988 message. That is not a human response and does not notify your clinician.
SMS program
After you opt in on the web form, Cadence may send recurring SMS and MMS (including voice memos and photos you send). Message and data rates may apply. Frequency is typically a few messages per week and may increase around appointments. Reply STOP to opt out. Reply HELP for help. You may also email contact@modulahealth.io.
SMS is not a secure channel. You agree that messages can be seen by anyone who can access your phone, carrier logs, or the thread.
Your responsibilities
- Provide a mobile number you control and keep it current.
- Do not invite or opt in anyone 17 or under.
- Do not use Cadence to seek emergency help.
- Understand that quotes and plans stored in Cadence are what you (or your clinician) entered, not an independent medical judgment by Modula.
Clinician invites and patient-named clinicians
If you invite a patient, you represent that you are authorized to use their number for this invite, and that Cadence will still require the patient’s own opt-in on the web form before recurring messages. If a patient names you and your email on the opt-in form, we email you a link to confirm they are in your care; we do not put their mobile number in that email. If they do not have your email, they get a link to share with you instead. You are responsible for your professional obligations. Cadence is a stenography and reminder tool, not clinical decision support that interprets or advises.
Accounts and links
Cadence does not use passwords. Signed links expire and may be single-use. Keep links to yourself. We may suspend access if we suspect abuse, fraud, or harm.
Intellectual property
Modula owns Cadence and its branding. You retain your words. You grant Modula a license to process those words solely to provide Cadence as described in the Privacy Policy.
Disclaimer
CADENCE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODULA DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free SMS delivery. Carriers may delay or block messages until messaging registration is approved.
Limitation of liability
To the maximum extent permitted by law, Modula is not liable for indirect, incidental, or consequential damages, or for missed sessions, missed medication, or health outcomes. Our total liability arising from Cadence will not exceed one hundred US dollars (US $100). Some states do not allow certain limits; in those states, our liability is limited to the fullest extent allowed.
Changes and termination
We may change these terms or stop offering Cadence. Continued use after a posted change means you accept the new terms. You may stop at any time by replying STOP and ceasing use. We may delete or export data as described in the Privacy Policy.
Governing law
These terms are governed by the laws of the United States and the state in which Modula Health is organized, without regard to conflict-of-law rules, except where a mandatory consumer law of your state applies.
